Terms and Conditions

Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the PomoZoom mobile application (the "App") operated by Agency Stellia ("us", "we", or "our").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the App.

1. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the PomoZoom App for your personal, non-commercial purposes on any Apple-branded products that you own or control and as permitted by the App Store Terms of Service.

2. User Accounts

  • Account Creation: To access certain features of the App, you must create an account. We use Firebase Authentication (a Google service) for account creation, which may involve using your email address, Google account, or Apple ID.

  • Account Responsibility: You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Subscriptions and Payments ("Pro Features")

  • Free and Pro Versions: The App may be used for free. We also offer a subscription-based "Pro" version that unlocks additional features, such as unlimited tasks.

  • Subscriptions: PomoZoom Pro is available on a weekly, monthly, or yearly subscription basis.

  • Billing and Payment: All payments and billing are handled by Apple through the App Store. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Your subscription will automatically renew at the end of each Billing Cycle unless you cancel it.

  • Cancellation: You may cancel your subscription renewal at any time through your Apple ID account settings. To avoid being charged for the next Billing Cycle, you must cancel the subscription at least 24 hours before it renews.

  • Refunds: Except when required by law, all purchases are final and non-refundable. Any refund requests must be directed to Apple, as we do not have the ability to process refunds.

  • Price Changes: We reserve the right to modify the subscription fees at any time. Any price changes will be communicated to you and will only take effect at the start of the next subscription renewal period.

4. User-Generated Content

You are solely responsible for the content you create within the App, such as your tasks, session notes, and settings ("User Content"). You retain all rights to your User Content.

As described in our Privacy Policy, your User Content is stored locally on your device and is not transmitted to or stored on our servers. We do not access, view, or claim ownership of your User Content.

5. Prohibited Conduct

You agree not to use the App to:

  • Engage in any illegal or unauthorized purpose.

  • Attempt to reverse engineer, decompile, or otherwise discover the source code of the App.

  • Interfere with or disrupt the service or servers.

  • Violate any applicable laws or regulations.

6. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Agency Stellia and its licensors. The "PomoZoom" name, logo, and all related names are trademarks of Agency Stellia.

7. Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You may terminate your account at any time by contacting us at support@pomo-tasks.com to request account deletion.

8. Limitation of Liability & Disclaimer of Warranty

The App is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind. To the fullest extent permissible by law, we disclaim all warranties, express or implied.

In no event shall Agency Stellia, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

9. Apple App Store Terms

  • This agreement is between you and Agency Stellia only, and not with Apple, Inc. ("Apple"). Apple is not responsible for the App or its content.

  • Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable); and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

  • Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

  • You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms against you as a third-party beneficiary.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law provisions.

11. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
